Dog Training Service Agreement

In consideration of the mutual covenants and agreements set out in this agreement,  Ridgeside K9   Eastern Carolina , (“ we ” or “ us ”) and                                        (“ the Client ” or “ you ”) agree as follows for the following:                                       ( “the dog” or “your dog”),  their canine, accepted into the  Ridgeside K9 Eastern Carolina  canine training program.

Client acknowledges that upon Ridgeside K9  Eastern Carolina’s   acceptance of this application, said document shall act as a value and enforceable contract pursuant to the Terms and Conditions set forth herein.

Ridgeside K9 Eastern Carolina Terms And Conditions

1. Intake Form and Continuing Disclosure:

You must complete and deliver to us through our website or directly the Ridgeside K9 Eastern Carolina Intake Form (the “ Intake Form ”) before any services will be provided to you by us. You represent and warrant to us that the information provided by you in the Intake Form is true and accurate. You will promptly disclose to us any changes to the information in the Intake Form and will provide any other information necessary for us to provide the services under this Agreement. In particular, you will:

Inform us of any bite history (dog or human), medical history, or allergies;

Your dog(s) has/have in addition to all known behavioral issues or fears;

Inform us if your dog is not spayed or neutered;

Inform us when your dog was last treated for fleas and ticks; and

Provide written proof that your dog(s) is vaccinated against distemper and parvovirus.

2. Training Services:

You engage us to provide, and we agree to provide, subject to the terms and conditions of this Agreement, for you and the dog(s) specified in the Intake Form, the services mutually agreed to as specified by you upon booking and confirmed by us to you by email or otherwise in writing. This Agreement applies to services we agree to provide to you at the time this Agreement is signed by you and to services we agree in the future to provide to you. Ridgeside K9  Eastern Carolina Trainer  The Parties mutually agree that Ridgeside K9  Eastern Carolina  shall assign a  Ridgeside K9   Eastern Carolina  Trainer  (“ Trainer ”) as the primary trainer for “ Dog”.  Each Trainer is a representative of Ridgeside K9  Eastern Carolina  and has successfully completed the Ridgeside K9  Eastern Carolina  evaluation before training any dogs for Ridgeside K9  Eastern Carolina . Ridgeside K9  Eastern Carolina  reserves the right to substitute a different Trainer, should that become necessary for any reason, who shall also be a Ridgeside K9  Eastern Carolina  Trainer.   Board & Train Programs and Prices:   Puppy Board & Train Programs Adult Board & Train Programs

3.     Evaluation and Goals:

Upon entrance to a board and train program, a Ridgeside K9 Eastern Carolina trainer (“Trainer”) and Client will conduct an initial evaluation. This evaluation will take place when the trainer picks up / takes custody of the dog. The purpose of the evaluation is to create a baseline of training and assess the dog’s skill levels and identify unsatisfactory areas needing improvement. Training will focus on the areas identified as unsatisfactory during the initial evaluation between the Trainer and Client. In general, the goals for the dog are:

To be controllable and polite around other dogs and people;

To perform basic obedience upon command; and

To reduce identifiable bad habits that may exist, such as: chewing, barking, jumping, rushing through doorways, counter-surfing, and begging for food at the table.

4.     Maintenance of Goals:

The Client recognizes that the training provided by our program will result in a dog that understands the expectations of the given commands and has experience ignoring basic to advanced distractions. Regardless of the dog’s success during in-person training.

For the dog to improve on or maintain the level of training provided while they were in the custody of Ridgeside K9 Eastern Carolina, the following must be applied:

The Client must understand and apply the basic principles of training

The Client must use the list of commands used by the

The Client must not interact with the dog in a way that rewards bad behavior and/or punishes good behavior.

The Client must understand that training is “all-day” “every-day”. The dog is learning and observing the moment it opens its eyes in the morning. “How you do something is how you do everything in the dog-world.”

The Client must follow the advice in terms of training and management as given by the trainer.

5 .    Expectations & Guarantee:

Expectations. The client understands and agrees that it may not be possible for every dog trained at Ridgeside K9 Eastern Carolina may not achieve all goals. For example, a dog may have a medical condition that prevents the dog from being reliably housebroken or the dog’s basic temperament may be aggressive by nature and not amenable to behavior modification. Medical conditions may interfere with commands, such as deafness, blindness, or any other physical impairment. Dogs that have medically diagnosed anxiety may need medication to reach their desired goals. The Trainer will notify the Client, prior to, during, or subsequent to the completion of the training program if the Trainer identifies areas that need additional training or training modification(s). Dogs will not be accepted into this program if the Trainer does not reasonably believe that the established goals for the dog could be achieved.

No Guarantee of Results.  You recognize that the role you play in your dog’s learning process is integral to achieving desired Success in training a dog is dependent on the interest, commitment, and cooperation of the dog’s owner. In addition, the dog may have underlying conditions, instincts or circumstances which inhibit reaching the desired training goals. You acknowledge and agree that there is no guarantee that your dog will achieve the desired level of training, despite the best efforts of Ridgeside K9  Eastern Carolina .

Guarantee. Ridgeside K9 Eastern Carolina does not, nor can it, guarantee successful progress in the dog’s behavior and discipline. However, the Client may submit a report to Ridgeside K9 Eastern Carolina of the dog’s failure to improve within thirty (30) days following the end of a board and train program. In Ridgeside K9 Eastern Carolina’s sole discretion, and upon Client’s showing that it complied with the Maintenance section of this Agreement, Ridgeside K9 Eastern Carolina may provide Client follow-up training sessions held at a location to be determined by Ridgeside K9 Eastern Carolina Trainer. Ridgeside K9 Eastern Carolina reserves sole discretion whether to issue a refund of any amount, or not, and may deny such a request if it believes the dog has made progress following its evaluation and/or Client failed to adhere to the maintenance program.

6.    Owner Training.      At the conclusion of training or behavior modification, the trainer will instruct the owner in the basics of training. Instruction will consist of the following: One drop-off session to show the owner the dog(s) new skills and to instruct the owner on how to give proper commands and properly reward and correct the dog in various situations. Additional 2 follow-up visits are provided for you. It is strongly recommended that the owner takes advantage of these The lesson dates and times will be determined with input from the dog owner.

7.     Fees and Payments:

Purchase Price. Client agrees to pay the Total Price for board and train program, as defined by Ridgeside K9 Eastern Carolina in accordance with the Client’s chosen board and train program. Each Client’s Total Price may vary depending upon the services rendered and the scope of the training and/or board and train package.

Payment. Client shall pay Ridgeside K9  Eastern Carolina , deposit of chosen board and train program (30% of the total price) within THREE (3) days of booking the chosen board and train program.

The remainder of the balance will be paid in a lump sum to Ridgeside K9  Eastern Carolina   Trainer at the inception of the training program.

Deposit Payments accepted by Ridgeside K9 Eastern Carolina: Payments can be made with cash, check, credit card (MasterCard, Visa, Discover, or Amex), and PayPal. Invoices will be sent via PayPal or QuickBooks.

Checks must be payable to: Ridgeside K9  Eastern Carolina, and mailed to 3430 Richlands Highway, Jacksonville, NC 28540

Checks returned will be subject to an additional late fee of no less than $50.00

3. Any changes in Dog Training Services made at the request of the Client may result in changes in rates or changes set forth in this Agreement. Any such change will be acknowledged in writing and signed by both Parties.

8.    Refund & Cancellation Policy: Payments for Dog Training Services are subject to the following refund and cancellation terms: If a Client cancels within twenty-four (24) hours of payment being processed , a refund may be issued minus a one hundred dollar ($100) non-refundable processing fee. This fee reflects payment processing and administrative costs incurred at the time of purchase. After twenty-four (24) hours from payment processing, all sales are non-refundable . Once training services have begun, no refunds will be issued for partially completed services, missed sessions, or early termination. Clients who cancel after the initial twenty-four (24) hour period may request to reschedule services or apply paid funds toward other services offered by Ridgeside K9 Eastern Carolina, subject to availability and scheduling policies. Requests for cancellation due to emergencies may be reviewed at our discretion. Approval of rescheduling or credit is not guaranteed and does not create a right to a refund. Board and Train programs must be scheduled and completed within one (1) year of purchase. Programs not booked within this timeframe will be forfeited without refund. If a Client elects to use third-party financing or Buy Now, Pay Later options, financing approval does not alter or override this refund and cancellation policy. Any repayment obligations to the financing provider remain the Client’s responsibility.

9.     Reschedule Policy:

The Owner is required to provide a minimum of fourteen (14) days written notice to Ridgeside K9 Eastern Carolina prior to the commencement date of the Dog’s Board and Train program. This notice period is necessary to facilitate the reallocation of the slot to another client. Any postponement of the start date may result in significant delays in rebooking, as slots are typically scheduled several weeks in advance.

Should the Owner request to reschedule the Board and Train program less than fourteen (14) days prior to the scheduled start date, Ridgeside K9 Eastern Carolina will be unable to accommodate such a request.

Rescheduling requests due to emergencies or injuries will be evaluated and addressed on a case-by-case basis at the sole discretion of Ridgeside K9 Eastern Carolina.

10.   Inclement Weather: In the event of severe cold or hot weather, or any other weather condition, which in our opinion threatens or impairs the health or safety of any dogs or persons participating in outdoor training sessions or the ability to productively carry out training outdoors, we reserve the right to move the training session indoors if a suitable indoor location is available.

11.   Veterinary Care:

Client further authorizes Ridgeside K9  Eastern Carolina  to incur and agrees to pay all veterinary expenses deemed appropriate by Ridgeside K9 for the dog during the time it is in Trainer’s care.

Veterinary Care:

If the dog requires non-emergency veterinary care during the training or boarding period, the trainer will make a reasonable attempt to contact the owner so the owner can obtain veterinary care for the dog. If the owner cannot be reached or is unable to tend to the dog’s need for veterinary care, or in the case of an emergency, the trainer will arrange on behalf of the owner for veterinary care to which the owner consents as set forth below. All veterinary fees are the responsibility of the owner. If convenient, the trainer will take the dog to the dog’s regular veterinarian, but the trainer reserves the right to take the dog to a veterinarian selected by the trainer, using reasonable care in the selection of a veterinarian.

Emergency Care:

Ridgeside K9 Eastern Carolina will take all reasonable and necessary precautions during the training and boarding processes to avoid illness/injury.

However, sometimes an illness or condition that was not diagnosed or discovered previously may present during the training or boarding period. When this happens, we need to be able to get the emergency care needed.

In the event of an emergency involving an injury/illness to your dog, we will try to contact you at the numbers provided to confirm your choice of action. If the Trainer cannot contact the Owner in a timely manner, the Owner hereby consents to veterinary care for the dog and gives the Trainer authority to consent to such treatment as the agent of the Owner:

In the event that Ridgeside K9  Eastern Carolina  cannot reach the owner or the owner cannot get to their dog, Ridgeside K9  Eastern Carolina  will be allowed to make decisions regarding emergency care reasonably required to save the dog’s life, to preserve the use of organs or limbs, or to alleviate severe pain. In the event that Ridgeside K9  Eastern Carolina  cannot reach the Owner, Ridgeside K9  Eastern Carolina  will be allowed to make decisions regarding emergency euthanasia, only if: recommended by the veterinarian, the owner cannot be reached after reasonable attempts, treatment is not likely to be successful, and the dog may be suffering or the expense of continued treatment may be unreasonable in light of the likely

3. If a non-serious but contagious (and hindering training) illness is detected, the dog may need to go back to the owner’s home for recovery. After that, the dog can return with new dates to Ridgeside K9  Eastern Carolina . Ridgeside K9  Eastern Carolina  may agree to have the dog recover here and will discuss it with the owner if that occurs.

The owner must arrange all other veterinary care when possible. The trainers’ time and transportation expenses must also be reimbursed. If the medical condition or emergency is not due to negligence on Ridgeside K9 Eastern Carolina’s part, the owner will cover all veterinary expenses involved in treatment, medications, hospitalization, and so on.

12.   Non-Disclosure and Vaccinations: Non-Disclosure : Non-disclosure of any known medical issues with the dog will result in contract termination, and Ridgeside K9  Eastern Carolina  will keep non-refundable fees or be owed additional fees if the respective service progressed beyond the first Vaccinations and Medications: The owner must provide the trainer with proof that the dog has been vaccinated for rabies, distemper, hepatitis, parvovirus, and parainfluenza, and a fecal test (within the last 6 months). The dog must be heartworm negative and on heartworm preventive, as well as on a flea/tick preventive. Any necessary medications or supplements must be provided by the owner, along with clear written instructions.

13.   Board & Training/Updates:

Boarding. The Trainer will take the dog for the entirety of the chosen training program. However the parties may agree to extend the stay if necessary, depending on the dog’s issues and progress. The dog while kenneling will be kept in a 5×5 walk-in kennel during its period of boarding. The dog will be provided with a raised bed, food, and a water bowl. If the dog seems to be of harm to himself, the Trainer will then consult with the Client and transfer the dog to a crate of appropriate size for the dog, only if a kennel is not appropriate. The dog will be kept at the Trainer’s private residence in a temperature-monitored and controlled area. The dog will be exercised and socialized as appropriate for the character of the dog and the purpose of the training. The dog will be transported to various locations for training and exposed to public places, such as but not limited to: hardware stores, pet stores, veterinary hospitals, group classes, parks, and more.

Updates. The Trainer agrees that updates on the dog will be provided via text message or email. Once a day at the conclusion of dogs training day. Updates are important and we will attempt to get you one daily. In the event you do not receive an updated training message. Text or call your assigned trainer to receive more information.

Visitations. Client understands that visits may be pre-arranged with said dog, however such visits will be at the convenience of the Trainer and may interfere with training. Client understands that Ridgeside K9  Eastern Carolina  and its Trainers work diligently to train dogs to the highest standards possible and any time taken away from said training will have an adverse effect upon the results of training and may postpone the dog’s return home. Client agrees that this program is not to provide complete comprehensive training for said dog but to expedite results that the Client will be responsible for completing at home.

14.   Dog Behavior:

Aggressive Dogs. The Client hereby represents and warrants that Client has disclosed to Ridgeside K9  Eastern Carolina  in writing (e.g., all forms and applications submitted to Ridgeside K9) any behavior that may indicate that the dog may be aggressive to other dogs or people, including but not limited to growling, forceful barking, snapping, raising of hackles, lowering of head and staring, chasing, attempting to bite, and biting. The Client understands and acknowledges that, while the trainer may be able to address some forms of aggression, many aggressive dogs require long-term treatment following a specific plan of action. The client understands that said dog may not “like, enjoy, or interact” with other dogs or people. Ridgeside K9  Eastern Carolina  never recommends leaving a dog that has shown signs of aggression alone with children or other animals. In aggressive cases, no matter the amount of training we do, we do not guarantee the dog will never be aggressive We cannot affect DNA and genetics. What we can do is keep the dog under control and manage it. It is the Client’s responsibility to understand at all times that it is on the Client to manage the dog and its environment to reduce the chances of possible accidents. Although the dog will be trained to a standard in a controlled environment, we never recommend the Client to have the dog off leash when out in public areas and places where leash laws apply.

The Client understands and acknowledges that some forms of aggression cannot be addressed with behavior modification and may require medication or euthanasia, both of which are outside the scope of this contract.

The Client represents and warrants that the dog is neither a danger to itself or other persons or animals. If a dog becomes ill or if the dog’s behavior is endangering itself, humans, or other animals, Ridgeside K9 Eastern Carolina, in its sole discretion, may engage the services of a veterinarian to assess and treat the dog for its behavior. Ridgeside K9 Eastern Carolina shall make reasonable attempts to contact the Client first; however, in the event of an extreme emergency, the wellbeing of the dog, Ridgeside K9 Eastern Carolina staff, and the other dogs in Ridgeside K9 Eastern Carolina’s care come first. Medication may be administered under the direction of a veterinarian. Client hereby gives Ridgeside K9 Eastern Carolina’s selected veterinarian authority to treat the dog in whatever manner deemed necessary and that it will be responsible for all veterinary charges upon release of the The Client also gives full authority for treating veterinarian and their associates to discuss with Ridgeside K9 Eastern Carolina any aspect of any illness or injury that the Ridgeside K9 Eastern Carolina has presented for treatment.

15.   Liability and Risk during Training and Boarding:

Ridgeside K9  Eastern Carolina’s  dog training program and boarding are inherently social in nature and with that come certain, unavoidable risks. These risks may include, but are not limited to:

Transfer of communicable diseases such as Canine Papillomavirus (Puppy Warts), Canine Cough, and Feline Upper Respiratory Injuries may also include, but are not limited to: broken nails, sore feet, puncture wounds, abrasions, and cuts. These injuries are generally benign and can usually be managed by our staff or at home. In some cases, veterinary care may be required.

Ridgeside K9  Eastern Carolina  shall exercise reasonable care for dogs delivered by the Client to Ridgeside K9  Eastern Carolina  for training and boarding. Client and Ridgeside K9  Eastern Carolina  hereby agree to limit Ridgeside K9  Eastern Carolina’s  liability for any damage to person, property, or dog injured during the dog’s training and boarding at Ridgeside K9 Eastern Carolina. In no event shall Ridgeside K9  Eastern Carolina  be liable to the Client for any amount higher than the fair market value for the dog boarded in the case of the dog’s injury or death. The Client further agrees to be solely responsible for any and all acts or behavior of said dog while it is in the care of the Ridgeside K9  Eastern Carolina . Client agrees to be financially responsible for Ridgeside K9  Eastern Carolina  property damaged by dog. Reasonable costs for damage will be payable upon the dog’s checkout.

Liability. All behavioral advice and training suggestions are provided at the Client’s own risk. Use of this information is voluntary and neither Ridgeside K9  Eastern Carolina , its employees, or its Trainer is responsible for injury to another human or animal. The Client expressly understands, acknowledges, and agrees that the Client is at all times responsible for the actions of the dog. With full knowledge of the foregoing, Client hereby releases and agrees to hold harmless Ridgeside K9  Eastern Carolina , its owners, directors, officers, members, employees, and agents from any and all liability, claims, suits, actions, loss, injury, or damage of any nature or kind, or for any liability, claims, suits, actions, loss, injury or damage which Client or dog may sustain or which may be caused in any way by the dog. Client, without limitation, agrees to fully indemnify Ridgeside K9  Eastern Carolina , for any and all such liability, claims, suits, actions, losses, injury, or damage. The client specifically agrees to indemnify and hold harmless Ridgeside K9  Eastern Carolina  as to any loss, cost, claim, injury, damage, or liability, sustained or incurred that is caused by an act or omission, whether negligent, intentional, or otherwise, of an employee, representative, or agent of Ridgeside K9  Eastern Carolina . The client understands and agrees that Ridgeside K9  Eastern Carolina  is in no way responsible for the behavior of the dog during or after training.

16.   Dog’s Health:      Client hereby attests that the dog has not been exposed to rabies or distemper within a thirty (30) day period prior to boarding. Ridgeside K9  Eastern Carolina  requires proof of current Rabies, Distemper, and Bordetella vaccinations (i.e. within the last six (6) months)—failure to produce such proof of vaccination may cause Ridgeside K9  Eastern Carolina  to decline to provide training and boarding services to the dog. The Bordetella vaccine is not 100% effective. It is recommended that it be given to your dog at least two (2) weeks prior to the dog’s arrival date to increase efficacy. Ridgeside K9  Eastern Carolina  makes no guarantees in regard to the Bordetella vaccine. All dogs are checked for external parasites (fleas/ticks) upon entry to the facility. If any external parasites are found, they will be treated accordingly and the Client will be responsible for those expenses. While the Dog is in Ridgeside K9  Eastern Carolina’s  care, in the event of an emergency where the Client is unreachable, the Client hereby authorizes Ridgeside K9  Eastern Carolina , its agents, employees and/or representatives to seek immediate veterinary care for the dog. Client understands and agrees that it shall retain sole responsibility for any and all costs incurred in connection with veterinary, medical, or other treatment.

17.   Your Rights and Our Relationship: You have the right to refuse to participate, or have your dog participate, in any part of our assessment, training class and/or behavior change program. If you have any concerns, please communicate them so that we can make adjustments as necessary within the boundaries of our training methods. You have the right to ask for further clarification as questions arise and the right to be clear on all relevant details about training before consenting to the consulting relationship. You have the option to request that any specific photos or videos of you and your dog be excluded from any of our promotional material. Ridgeside K9  Eastern Carolina  and its principals are independent contractors and none of them, or their employees or agents, are your employees. If you provide us with keys, remote control entry devices, access codes or similar devices or information to provide our services, we will keep those devices and information safe and confidential and return any such devices when we are no longer providing services or on request.

18.  Release of Liability:      You agree that in consideration for being permitted to participate in dog training provided by Ridgeside K9  Eastern Carolina , and/or to use any Ridgeside K9  Eastern Carolina’s  facilities in connection with dog training, you, your own behalf for your heirs, next of kin, executors, administrators and personal representatives (collectively, “ Releasors ”), assume the entire risk associated with participating in such an activity and waive, release, discharge and covenants not to sue Ridgeside K9  Eastern Carolina , its owners, directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers or other representatives, their successors and/or assigns (collectively, “ Releasees ”), or any of them, from any and all liability to any of the Releasors for any loss, expenses, harm, damage, claim, personal injury (including death) or accident to your person or property, your dog, or any other persons accompanying you at the dog training, including any minor children, arising out of or related to participating in dog training, the providing of services to you pursuant to this Agreement, or using any facilities or equipment of Ridgeside K9  Eastern Carolina , even if caused by any negligent act or omission of any of the Releasees. Nothing herein is intended to release any of the Releasees from any harm, injury, claim, or damage caused by his or her intentional, wanton, or reckless  misconduct.

19.   Indemnification:

You agree that you are and will be responsible for your conduct and the conduct of your dog and others accompanying you (including minor children) at all times. You agree to indemnify and hold harmless each of Ridgeside K9  Eastern Carolina , its owners, directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers, and other representatives, including but not limited to collectively, Ridgeside K9 Eastern Carolina Personnel, from any and all claims of personal injury (including death), loss, cost, expenses (including but not limited to legal fees and expenses), or damage to persons, dogs, or property caused by the acts or omissions of you, your dog, and any other persons accompanying you, including any minor children, during the course of training, receiving services from us under this Agreement, or related activities, as well as by the conduct of your dog under your own care as a result of following training instructions.

This provision applies whether the claims are made by you, members of your family, your accompanying guests, any of the Ridgeside K9  Eastern Carolina  Personnel, or other third parties.

20.   Media Release:      You consent to us taking photographs and videos of you and/or your dog. By signing below, you give Ridgeside K9  Eastern Carolina  permission to publish in print, electronic, or video format, the likeness or image of you and/or your dog and basic information concerning your dog, for the purposes of education or advertising or promotion of Ridgeside K9  Eastern Carolina . You release all claims against Ridgeside K9  Eastern Carolina  with respect to privacy rights, publicity rights, copyright ownership, and publication, including any claim for compensation related to the use of the materials.

21.   Personal Information:      You consent to us collecting, storing, and using personal information about you and your dog, including your name, address, and contact information, for the purpose of providing the services contracted for under this Agreement and the handling and safekeeping of your dog and your personal safety. We will not disclose that personal information to any third party except you agree that we may disclose portions of that personal information to third parties only in the event it becomes reasonably necessary, and only to the extent reasonably necessary, for providing the services contracted for under this Agreement and complying with its terms, or the handling and safekeeping of your dog or your personal safety or the safety of others.

22.   Right to Terminate: We reserve the right to terminate this Agreement if: any of the information you provided in the Intake Form is not true; in our sole opinion your dog is vicious or dangerous to our trainers or any other dog or person; in our sole opinion your dog interferes with the training of other dogs to an unacceptable extent; in our sole opinion continuing to provide services for your dog is not in the best interests of any of the dog, you, or us, for any reason.       If we terminate for any of these reasons, we will refund you the fees you have paid which are attributable to any unused  sessions.

2 3.  Outside Services by Trainer:      If the Owner and Trainer elect to engage in any boarding, dog walking, or other dog care services of any nature, by signing this Agreement, the Owner acknowledges that the Trainer is not performing such services as an employee of Ridgeside K9  Eastern Carolina  but as a private matter, outside the scope of this Agreement, and Trainer’s employment agreement. As such, the Owner understands and agrees that the Owner shall not hold Ridgeside K9  Eastern Carolina  liable for any manner for the actions and/or care that may occur during such private boarding or care services.

24.     Entire Agreement:      This Agreement, the Intake Form, and the services and bookings chosen by you through our website and confirmed by us constitute the entire agreement between you and us with respect to the services provided by us to you and there are no other agreements, undertakings, representations, warranties or understandings, written or oral, express or implied, other than as set out in this Agreement or those documents. This Agreement may only be modified by an express written agreement, made after this Agreement has been executed, which both we and you have signed.

25.   Severability:      If any provision of this Agreement is held to be invalid or unenforceable, in whole or in part, the invalid or unenforceable provision or portion will be severed from this Agreement and will not affect the legality, validity, or enforceability of any other provision of this Agreement.

26.   No Waiver:      No waiver of any provision of this Agreement will be binding unless made in writing. No condoning, excusing, or overlooking of any default, failure, or delay in exercising any remedy, will operate as a waiver of any subsequent default.

27.   Time is of the Essence: Time will be of the essence of this Agreement.

28.   Governing Law:      This Agreement, including the documents delivered in connection with this Agreement, shall be construed, interpreted, and enforced in accordance with the laws of the state of North Carolina, without regard to its conflict of law principles. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of North Carolina.

29.   Enurement; No Assignment:      The terms of this Agreement will be binding on, and ensure to the benefit of, you and us and our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. This Agreement may not be assigned by either party without the express prior written consent of the other party.

30.    Execution in Counterparts and Electronic Delivery:      This Agreement and the Intake Form may be completed and/or signed in separate counterparts, each of which may be delivered through our website, by email, or in other electronic form, and all counterparts together will constitute one and the same agreement.

31.  Attorney’s Fees and Costs:      Client understands and agrees that in any action or proceeding brought by Ridgeside K9  Eastern Carolina  to enforce its rights under, or as a result of the Client’s breach of this Agreement, in which Ridgeside prevails, Ridgeside K9  Eastern Carolina  shall be entitled to recover from the Client, Ridgeside K9  Eastern Carolina’s  costs and attorney’s fees incurred in any such action or proceeding.

32.   Authority to Sign, Acknowledgment, and Voluntary Execution:

Authority to Sign, Acknowledgment, and Voluntary Execution. By either downloading and signing a paper copy or by clicking ‘I Agree’ with our online system, you declare that you are at least 18 years of age and competent to sign this Agreement. For registration and booking of training via the website, clicking I agree constitutes as your electronic signature. You agree and consent that your electronic signature is the legally binding equivalent to your handwritten signature. You will not, at any time in the future, repudiate the meaning of my electronic signature or claim that my electronic signature is not legally binding.

You acknowledge that you have carefully read this Agreement, understand its contents, and agree to be bound by its terms. You specifically understand that this Agreement includes an assumption of the risk of Ridgeside K9  Eastern Carolina’s  negligence and a release of Ridgeside K9  Eastern Carolina’s  liability.

Transportation Agreement

This agreement is made by and between Ridgeside K9 Eastern Carolina and the Owner (referred to as “You”).

WHEREAS the Owner has requested that Ridgeside K9 Eastern Carolina provide transportation for the Owner’s pet to any location within the Raleigh, Jacksonville,  Havelock, New Burn, Wilmington, North Carolina areas that supports and benefits the training goals, as defined in the online transaction summary.

WHEREAS Ridgeside K9 Eastern Carolina provides non-medical transportation services for pets; and

WHEREAS the Owner, being fully informed of this fact, requests Ridgeside K9 Eastern Carolina to transport the Owner’s pet as specified;

NOW THEREFORE, Ridgeside K9 Eastern Carolina and the Owner agree as follows:

Transportation Service: Ridgeside K9 Eastern Carolina will transport the Owner’s pet as

Pet Health Condition: The Owner warrants that the pet is healthy and in good physical condition.

Ridgeside K9 Eastern Carolina Responsibility: Ridgeside K9 Eastern Carolina will make every effort to care for the pet during transport. However, Ridgeside K9 Eastern Carolina assumes no responsibility for injuries, sickness, death, or other disabilities that may occur during transportation. In consideration of this agreement, the Owner fully releases Ridgeside K9 Eastern Carolina, its employees, agents, and drivers from any and all liability arising from the transportation of the pet, including injury, sickness, or

Ridgeside K9 Eastern Carolina agrees that the Owner’s pet will be securely transported in an appropriately sized kennel at all times during In cases where the size of the dog (such as giant breeds) prevents kennel use, alternative secure transportation methods will be employed to ensure the safety and well-being of the pet.

Entire Agreement: This agreement represents the entire understanding between Ridgeside K9 Eastern Carolina and the Owner regarding transportation. Any amendments must be in writing and signed by both parties.

Governing Law: This agreement shall be governed by the laws of the State of North Carolina, and any disputes shall be resolved in the courts of North Carolina.

Ridgeside K9 Transportation Services Waiver & Release

By using Ridgeside K9 Eastern Carolina’s transportation services, you assume full risk and release Ridgeside K9 Eastern Carolina from all claims related to injuries, damages, or loss your pet might sustain during transportation, including but not limited to entering and exiting the vehicle. Pets are unpredictable by nature, and we recognize the potential risks involved.

I acknowledge that there are risks of physical injury to the pet during transportation and voluntarily agree to assume the full risk of any injuries, damages, or loss that my pet may sustain during transportation. I further agree to release Ridgeside K9 Eastern Carolina and its employees, owners, agents, and contractors (collectively referred to as “Party”) from any and all claims arising from or related to transportation services, including but not limited to negligent vehicle operation.

I fully release and discharge the Party from any claims for injuries, damages, or losses related to my pet during transportation. I agree to indemnify and hold harmless the Party from any claims or legal fees that arise in connection with the provided transportation services. Ridgeside K9 Eastern Carolina takes precautions to prevent pets from running away (Kennels during transport and GPS Collars are required for all Board and Train Dogs); however, animal behavior cannot be perfectly controlled at all times. I will not hold the Party responsible if my pet flees during transportation or care.

I acknowledge and accept that Ridgeside K9 Eastern Carolina provides non-emergency transportation, and no medical services will be provided. Ridgeside K9 Eastern Carolina reserves the right to refuse or remove any animal from transport if the animal exhibits aggressive behavior, refuses to be loaded, or is deemed unfit for transportation by an employee.

This agreement shall be governed by the laws of the State of North Carolina.

Authorization for Use of Training Tools​

By enrolling in any training program offered by Ridgeside K9 Eastern Carolina, the Owner acknowledges and grants authorization for the use of various training tools that may be deemed appropriate for the training needs of the Owner’s dog. These tools may include, but are not limited to, the following:

Prong/Pinch Collar

Slip Lead Leash

The selection and use of these tools will be tailored to the specific needs, behavior, and temperament of the owner’s dog, with the primary objective of ensuring effective training, safety, and positive outcomes. All training tools will be applied by Ridgeside K9 Eastern Carolina’s experienced trainers in a responsible, humane, and professional manner, with a focus on fostering a balanced and cooperative training environment.

Ridgeside K9 Eastern Carolina reserves the exclusive right to determine the most suitable training tools based on a professional assessment of the dog’s behavior and progress throughout the training program. The Owner’s enrollment in any Ridgeside K9 Eastern Carolina program constitutes consent to the use of such tools, as determined necessary by the trainers.

If the Owner has any concerns or preferences regarding the use of specific tools, these must be communicated to Ridgeside K9 Eastern Carolina in writing prior to the commencement of the training program.
